Article 2: Subject and Terminology

These general conditions of sale also called “conditions of use” establish the rights and obligations of the parties in the context of the sale of products by the company LUCK’S to customers on the website ” ALSportswear “, called ” the website “.

The Internet buyer on the website is referred to as “the customer”.

The customer declares having read these general conditions of sale and having accepted the rights and obligations relating to them. All orders placed on the ALSportswear website are subject to these conditions.

The products displayed on the website “ALSportswear” are referred to as ” the products “.

Each purchase or reservation of a product on the website is called “the order”.

Article 3: Conformity and availability of the products

While the LUCK’S company has made every effort to display as accurately as possible the colours and images of our products on “alsportswear.com”, the images of the products only have an indicative value and changes may have occurred during the editing process. Moreover, due to the different colours on computer monitor’s display, it is possible that the perception of the picture of a product by the viewer does not correspond exactly to the product itself.

In case of non-conformity of the delivered product, the customer may return it in its original state and packaging to the company LUCK’S and may request to be delivered an identical product or a product of equal quality and price to the one ordered, subject to availability.

The costs and risks of returning the product to the LUCK’S company will be the responsibility of the customer. The delivery costs of the replacement product(s) will be borne by the company LUCK’S.

In case of partial or total unavailability of the product after ordering, the customer will be informed by email or phone call to choose between a partial delivery or cancellation of their order. In this case and according to the article L 121-20-3 of the French Code of Consumption, the customer can choose to be delivered with a product of the same quality and price to the one ordered within the stock available or to be refunded the price of the ordered product within 15 days following his request.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We reserve the right but are not obligated, to limit the sales of our products to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product made on this site is void where prohibited.
While we do our best to keep our customers happy, we do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations.

Article 4: Terms of order, price and payment

By confirming your order online during the ordering process (by clicking the “Order” button), the customer declares full and unreserved acceptance of these General Conditions of Sale.

The company LUCK’S reserves the right to refuse any order from an Internet user with whom a dispute would exist.

After having checked the contents of their order, and if necessary having modified it, the customer will confirm it by proceeding to the payment. Their order will only be final once the payment step has been finalized and considered effective after confirmation of the payment platforms.

Confirmation: the order is confirmed to the customer by an e-mail sent by the company LUCK’S, via the website “alsportswear.com” after verification of the payment.

 

Article 5: Payment

The prices for each product are displayed on respective product pages and are inclusive of taxes. The shipping costs of the customer’s order are indicated on the checkout page. If shipping costs are free, this is mentioned on the shipping costs line.

Prices and fees will remain visible in the “my account” section of the website, after payment of the order if the customer has created an account on “alsportswear.com”.

The provisions of the General Tax Code concerning VAT will be applied for supplies outside the French territory.

Payment of purchases is made by credit card or PayPal account. Accepted credit cards are CB, Visa, American Express and MasterCard.

The customer guarantees that they are authorized to use the credit card used to pay for his order and that the account associated with the card is adequately funded to cover the purchase of products on the ALSportswear website.

 

Article 6: Payment security

The online payment systems used by ALSportswear are the secured “PayPal (Braintree)” and “Stripe”. All payment steps between the customer and PayPal (Braintree) and Stripe are fully encrypted and protected. The protocol used is SSL (Secure Socket Layer) coupled with bank electronic payment, which means that the information related to the order and the credit card number does not circulate openly on the Internet. The credit card number is not printed on any paper, receipt or other listings. The ALSportswear website has no knowledge of the card numbers.

Article 7: Right of withdrawal

Prior returning a product, the customer will have to indicate their intention through the “contact us” page on the website ALSportswear within 30 days of their purchase.

The following conditions must be fulfilled by the customer:

– the product returned must be in perfect condition (not damaged or soiled), that it has not been subject to long-term use (beyond a few minutes), that it does not bear the evidence of prolonged use beyond the necessary time for its testing, that it is properly protected in its original packaging, in a perfect state for resale and accompanied by any accessories and labels. Damaged, soiled, altered or incomplete items will not be accepted.

– the invoice is joined to the return package in order to properly identify the customer (order number, surname, first name, address).

– the reason why the customer would like to return the product.

– a note with the name (and size and other details if needed) of the product the customer would like to receive in exchange or the demand for a credit note or the reimbursement of the product.

The costs and risks related to the return of the product are the responsibility of the customer.

 

Article 8: Delivery

8.1. Delivery address: The products will be sent to the delivery address indicated by the customer during the ordering process. In case of absence at the time of delivery to the address indicated by the customer, a delivery notice is usually left in the mailbox. It is then possible to withdraw the package in a post office within 10 days following the deposit of this note. If the package is delivered by a carrier, a notice is also left in the mailbox at the address indicated by the customer when ordering. It will then be up to the customer to contact the carrier to agree on a new delivery date or to look for the shipment itself at the warehouse according to the deadlines indicated by the carrier. In the case of exceeding the above-mentioned deadlines, the package will be returned to LUCK’S.

8.2. Delivery time: The usual delivery time is 2 to 7 working days, starting from the day the order is placed but it will depend on the country the order is shipped to. For more details on the exact date, simply ask the question via the “contact us” section of the ALSportswear website.
Exception: In the case of longer delivery times due to delays in the LUCK’S company, the customer will be informed within 72 hours by e-mail. In this case he will have the choice between keeping his order, changing the item or receiving a full or partial refund of his order.

8.3. Absence or delay of delivery: In this case, the customer can contact ALSportswear customer service in the “contact us” section of the website. The customer has the option to cancel his order if the delivery of this one did not occur within 15 working days after the maximum delivery time unless this delay or the absence of delivery is due to a case of absolute necessity within the meaning of the jurisprudence of the French Courts.
Within 10 working days following the cancellation request by the customer, the company LUCK’S will issue a refund request.

8.4. Except for special cases or unavailability of one or more items, the items ordered will be delivered at once in one package, when they are part of the same order.

8.5. In case of partial delivery, the customer will be informed by e-mail.

8.6. Each delivery is considered as done as soon as the product is at the disposal of the customer, as indicated in the delivery tracking system on the website of our delivery service “La Poste” for the “Colissimo” service.

8.7 It is up to the customer to check the product(s) upon arrival and to make any claims or complaints which would appear justified and even to refuse the package if it is likely to have been opened or if it bears clear damage signs. These claims and complaints must be addressed to the carrier by registered letter with acknowledgement of receipt within three working days following the delivery of the products. A copy will immediately be addressed to the company LUCK’S.

8.8 If the customer selects the ‘pick up at warehouse’ option and cannot pick up their purchase, they have the option to contact ALSportswear to pay for the shipping costs in order to get their order delivered.

 

Article 9: Case of force majeure

The company LUCK’S declines any responsibility in case of non-execution due to reasons beyond its control, and in particular in case of fire, flood, earthquake, explosion, accident, failure of transportation, legal or governmental actions, natural disasters…

 

Article 10: Confidentiality of personal data

The company LUCK’S commits not to reveal to third parties the information communicated by customers on the website.
They are considered as confidential. The data will only be used by its internal services to process the customer’s order, strengthen and personalize communication, in particular by e-mail and to contribute to the development of the website and the brand.

LUCK’S does not sell or rent personal data regarding its customers to third parties. However, it may send information and commercial offers from partners to its customers.

The company LUCK’S can occasionally provide statistics relating to its customers, its sales and mail exchanges relating to information on the website to trusted third parties, but these statistics do not contain any personal data.

In the case where any of the articles or terms of these General Conditions of Sale is considered illegal or unenforceable by a court decision, the other provisions shall remain in force.

In accordance to Articles 1316 and subsequent of the French Civil Code and, where applicable, Article L.110-3 of the French Commercial Code, the information provided on the website is authentic between the parties.

Elements such as the time of receiving or issue, as well as the quality of the data received will be authentic by priority as appearing on the information systems of “ALSportswear”, or as authenticated by the computerized procedures of “ALSportswear”, unless the customer provides written proof to the contrary.

The scope of proof of the information delivered by the computer systems of alsportswear.com is the one which is granted to an original within the meaning of a written paper document, signed in a handwritten way.

Article 12: Applicable right and Conflicts Handling

These General Conditions of Sale, originally written in French, shall be executed and interpreted in accordance with the French law.

In the case where a conflict arises from the present contractual relationship, the parties commit to seek an amicable solution before any legal action, by addressing the LUCK’S company either by registered letter or via the “contact us” section on the website ALSportswear.

Any conflict arising from the present contract will be subjected to the French law and falls under the exclusive competence of the courts of Strasbourg for business or the Court (Tribunal du domicile).
